Welcome to the portal www.oma.aero (hereafter the "Portal"), property of Grupo Aeroportuario del Centro Norte S.A.B. de C.V. ("OMA"). This Portal is freely available for use by you (the "User") upon the condition that you accept fully the terms and conditions contained in these General Conditions. The fact that you use the Portal in itself constitutes acceptance of these General Conditions. If the User does not accept the General Conditions, such User shall not use the Portal. In the event the User continues use of the Portal, such action shall be considered full and absolute acceptance of all the General Conditions.
Through the Portal, OMA offers the User the access to various services and content (the "Services"). These Services may be from OMA as well as third party providers of services contracted by OMA. The access and use of the Services shall be free except in certain situations as expressly required by the subscription and registration of the User in accordance with the terms of Section 3 herein.
All contents of this Portal, including but not limited to graphics, logos, icons, images, audio, clip, texts, and software are the property of OMA and the rights thereto are protected by the Industrial Property Law (Ley de la Propiedad Industrial) and its Regulations, and by international treaty. In accordance with such Regulations, the reproduction, modification, distribution, transmission, re-publication, exhibition, or execution of that contained in this Portal, without express written consent from OMA is strictly prohibited. The OMA mark and its logos are duly registered in Mexico as well as in other countries. The User is expressly prohibited from modifying, altering, or deleting, either in whole or in part, the notices, marks, commercial names, signs, announcements, logos, or generally any indication that refers to the ownership of the information contained in the Portal.
To use the Services on line, the User shall complete the request for registration on-line ("Registration Request"), and upon completion, click "Accept", and shall be obligated by the entirely of these General Conditions.
After having sent the Registration Request, OMA shall process and, if applicable, authorize in its sole discretion the Registration Request. If authorized, OMA shall assign the authorized User an account to access and to use the OMA Services on-line, which account shall consist of a Password, User ID, and an email account. The User commits to make correct use and to keep its Password and User ID assigned for the access to the OMA Services on-line confidential. The User shall be liable for any and all damages (daños y perjuicios) for unauthorized and undue use by third parties of the OMA Services on-line, where the User ID and Password of the User were used, due to their loss by the User. The User is obligated as follows: 1) to notify OMA immediately of undue and/or unauthorized use of its Password, User ID, and Email, and 2) to ensure that upon completion of User's search on the Portal, to exit its account.
The User is obligated to use the Email solely to send and receive personal and business messages for the company of the User. Any unauthorized commercial use of the Email is prohibited as is the re-sale of the Services.
The User is obligated to comply with all local, state, national, and international rules and is the sole responsible party for all its acts or omissions that occur related to its Email, User ID, or Password, including for the content of all its transmissions through the Email.
OMA may cancel without prior notice or any liability whatsoever any Email account it considers, within its sole discretion, which such account sends or is in any way related to any unsolicited spam of bulk email or that sends emails OMA deems to be obscene.
OMA shall have no obligation to supervise the Email or the use made by the User, nor shall OMA have any obligation to save the contents of any User session. Notwithstanding the foregoing, OMA reserves the right to supervise, review, save, and/or disclose at any time, any information that may be necessary to comply with any law or regulation, legal proceeding, or any applicable administrative proceeding requirement.
OMA guarantees the User the right to privacy in conformance with its Privacy Policy. The User accepts that in addition, OMA may have access to its account for the purposes of responding to technical or service requirements.
To the maximum extent permitted by applicable law, OMA shall not be liable, in any event, for any direct, special, incidental, indirect, or consequential damages in any form (including without limitation, damages for business interruption, loss of data, or any other monetary or financial loss) that derive from or relate to (i) the use or execution of the Portal and its Services, (ii) the delay or failure of availability of use of the Portal, (iii) the provision of or lack of the provision of the Services, of any information or graphics contained or published in or through the Portal, (iv) the updating or failure to update the information, (v) that the information has been altered or modified, in whole or in part, after having been included in the Portal, (vi) any other aspect or characteristic of the information contained or published in the Portal, or through the links that are included in the same.
OMA assumes no liability or responsibility in any manner for the form in which the User employees the information contained or published in or through the Portal and/or the Services. The Users are recommend to verify this information by their own means at the time of making any decisions based thereon. The User, in any event, should always consult a technical or administrative adviser, whichever is applicable.
Notwithstanding that the information in this Portal is considered to be correct, it is possible that it contains technical or typographical errors. OMA shall attempt to update the contents of the Portal in a continual manner.
OMA does not guarantee that the Portal satisfies the requirements of the User, or that the Services are or shall be maintained in an uninterrupted manner, on time, secure, or free from errors.
The User agrees to indemnify OMA from any action, demand, claim (including attorneys fees and court costs), derived from any breach by the User of these General Conditions, including without any limitation those arising: (i) for any reason related to the use for the Portal and its Services, of the information contained in or through the Portal, (ii) for injury, defamation, or any other violating conduct by the User in the use of the Portal and/or the Email and/or Communities, (iii) for violation of the laws or applicable international treaties related to copyright or intellectual property contained or available in or through the Portal, or (iv) for the use of the Portal and its Services made by any unauthorized person on the Portal, using the User ID, Password, and/or Email of the User.
The use of this Portal for illegal purposes of for anything not authorized by these General Conditions is strictly prohibited.
A cookie is any chain of text that is installed in the hard drive of the User's computer and each time that the User enters the Portal sends information that will be used to identify the user. The User accepts that OMA, through the Portal, shall automatically install a Cookie on the User's computer.
This agreement shall have an indefinite duration. Notwithstanding the immediately foregoing, the User accepts that OMA may cancel the User ID, Password, and/or E mail of any User for misuse of the Portal, for violations of these General Conditions, or any other reasons, at the sole discretion of OMA, at any time and without prior notice.
OMA reserves the right to modify unilaterally, at any time and without prior notice, the presentation and configuration of the Portal. OMA further reserves the right to modify or eliminate, at any time and without prior notice, the Services and the conditions required to enter and/or use the Portal and the Services, as well as these General Conditions.
Without any liability, OMA shall have the right to temporarily or permanently suspend the provision of the Services.
The User, upon using the Portal, accepts and agrees that any dispute arising from the interpretation, compliance with, or execution of the provisions stipulated in these General Conditions, as well as for purposes of regulation of the transactions between the User and OMA, shall be submitted to the applicable and then current law in Mexico City, Mexico (México, Distrito Federal), and to the jurisdiction of the competent tribunals of the same, expressly waiving any other forum that may correspond to the User due to their future domicile or any for other reason.
